Court Rules in Favour of School Boards, Denying Social Media Giants’ Move to Dismiss Litigation

On March 7, 2025 Justice Leiper of the Ontario Superior Court released a decision dismissing a motion brought by Meta, Snapchat, and Tiktok to strike the claims of our school board clients.

The lawsuits on behalf of school boards and independent schools call on social media giants to redesign their products to keep students safe, and to address the significant costs of widespread disruption to the education system. We are proud to move forward with this important litigation.

Duncan Embury, Partner and  Head of Litigation here at Neinstein, has been quoted in several Canadian media outlets discussing this case update, including Global NewsCBC, and Toronto Star

“This is the first step in achieving justice for the education system, and ultimately the next generation of leaders,” says Embury. “Now that we’ve been successful in this motion, the case can proceed to trial to hold social media giants accountable.”
